the code for tp_smapi has not changed in years, it is always a trivial rebuild; so its more likely something about the kernel - maybe try loading the module with modprobe, while watching dmesg
i checked the github issue tracker - there was one bug similar report this month, which has a list of supported machines - the T400 is listed

I thought that it might be related to lacking a modprobe.conf file, I made one and put the default recommended params as per the docs here:
https://thinkwiki.org/wiki/tp_smapi#T_series
https://github.com/linux-thinkpad/tp_smapi
But neither force_io=1 or debug=1 are recognized by tp_smapi (thinkpad_ec isn't complaining about force_io=1, but that isn't changing anything when trying to load tp_smapi).
Maybe the module was compiled in such a way as to not accept params at all?

I tried to close the issue - apparently it is an issue with Core/Libreboot and the module isn't supposed to work.
The solution is to use ectool (from coreboot).
